Terms and Conditions

By accessing, viewing, purchasing, downloading, or using any services, images, products, or online galleries provided by Seventy Nine Photography ("Company," "we," "our," or "us"), you agree to the following Terms and Conditions.
1. Photography Services
Seventy Nine Photography provides photography services including, but not limited to:
School Portrait Photography
Yearbook Photography
Sports League Photography
Senior Portrait Photography
Graduation Photography
Corporate Headshots
Real Estate Photography
Event Photography
All services are subject to availability and scheduling.
2. Orders and Payments
All orders placed through our online ordering platform must be paid in full at the time of purchase unless otherwise specified.
Prices, promotions, discounts, and product offerings are subject to change without notice.
Seventy Nine Photography reserves the right to refuse or cancel any order due to pricing errors, suspected fraud, or product availability issues.
3. Image Proofing and Ordering
Proof images are provided for viewing and ordering purposes only.
Customers are responsible for reviewing image selections, poses, crops, and products prior to submitting an order.
Once an order is submitted, modifications may not be possible.
4. Digital Image Purchases
Digital images purchased through Seventy Nine Photography are licensed for personal, non-commercial use only.
Customers may:
Download purchased images
Share images on personal social media accounts
Print images for personal use
Customers may not:
Sell images
Transfer ownership rights
Use images for commercial advertising without written permission
Alter images in a way that misrepresents the original work
Copyright remains the exclusive property of Seventy Nine Photography.
5. Copyright and Ownership
All photographs, digital files, designs, graphics, and related materials are protected by United States copyright laws.
Seventy Nine Photography retains all copyrights and intellectual property rights to all images unless otherwise agreed in writing.
The purchase of prints or digital files does not transfer copyright ownership.
6. Image Delivery
School and sports proofs are generally delivered within approximately ten (10) business days after picture day.
Delivery times are estimates and may vary due to volume, holidays, weather events, or circumstances beyond our control.
Digital downloads become available after payment processing is complete.
7. Print Quality and Color Variations
Actual print colors may vary slightly from those displayed on computer monitors, tablets, or mobile devices.
Such variations are normal and do not constitute defects.
8. Refunds and Exchanges
Due to the customized nature of photographic products, all sales are generally final.
Refunds or replacements may be offered in the following circumstances:
Product defects
Printing errors
Shipping damage
Company processing errors
Requests must be submitted within fourteen (14) days of receiving the order.
Seventy Nine Photography reserves the right to determine whether a replacement or refund is appropriate.
9. Shipping
Shipping timelines are estimates provided by shipping carriers.
Seventy Nine Photography is not responsible for delays caused by postal carriers, weather conditions, incorrect addresses provided by customers, or other circumstances beyond our control.
Customers are responsible for providing accurate shipping information.
10. Retakes and Image Concerns
Retake opportunities may be offered at the discretion of the school, organization, league, or Seventy Nine Photography.
Requests regarding image quality or concerns should be submitted promptly after receiving proofs.
11. Limitation of Liability
In the unlikely event of equipment failure, image corruption, loss of files, acts of nature, venue restrictions, or circumstances beyond our reasonable control, liability shall be limited to the amount paid by the customer for the affected services or products.
Seventy Nine Photography shall not be liable for indirect, incidental, or consequential damages.
To the fullest extent permitted by law, Seventy Nine Photography's total liability for any claim, loss, damage, injury, expense, or dispute arising out of or relating to photography services, products, digital files, website use, or any transaction with the Company shall be limited to the total amount actually paid by the customer for the specific services or products giving rise to the claim.
Under no circumstances shall Seventy Nine Photography be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to lost profits, emotional distress, loss of opportunity, or third-party claims.
Any legal action, claim, or proceeding arising out of or relating to services provided by Seventy Nine Photography must be brought exclusively in a court of competent jurisdiction located in Angelina County, Texas.
The customer agrees that any recovery against Seventy Nine Photography shall not exceed the amount paid by the customer for the specific services or products involved in the dispute.
If Seventy Nine Photography prevails in any legal action, arbitration, collection proceeding, or dispute arising from the customer's use of the Company's services, products, or website, the customer agrees to reimburse Seventy Nine Photography for all reasonable attorneys' fees, court costs, filing fees, collection costs, expert witness fees, and other expenses incurred in defending or enforcing its rights.
The customer expressly waives any claim for damages in excess of the amount paid to Seventy Nine Photography for the applicable services or products, except where such waiver is prohibited by applicable law.
12. Website and Platform Usage
Users agree not to:
Attempt unauthorized access to systems
Interfere with website functionality
Use automated software to download content
Violate applicable laws while using the platform
Unauthorized use may result in account restrictions and legal action.
13. Privacy
Information collected through our ordering platform may include names, email addresses, phone numbers, student information, and shipping details.
Information is used solely for order fulfillment, customer service, communications, and business operations.
We do not sell customer information to third parties.
14. School and Organization Data
When provided by schools, leagues, or organizations, customer information may be used solely for photography-related services, proof delivery, customer support, yearbook production, and order fulfillment.
Seventy Nine Photography complies with applicable privacy laws and industry standards regarding student information.
15. Promotional Use
Seventy Nine Photography may use photographs for portfolio, website, social media, marketing, competition, and promotional purposes unless prohibited by a written agreement or applicable school policy.
16. Changes to Terms
Seventy Nine Photography reserves the right to update or modify these Terms and Conditions at any time without prior notice.
Updated versions will become effective upon posting to our website or ordering platform.

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.
Any dispute arising under these Terms and Conditions shall be resolved exclusively in Angelina County, Texas.
